GENERAL TERMS AND CONDITIONS <\/strong><\/span><\/p>\n

1 – SERVICES AND CONTRACT FORMATION <\/strong><\/p>\n

By booking or using any of the services listed on this website, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions. The information provided on the website about the services offered is an integral part of this contract and may not be altered without the express agreement of both parties.<\/p>\n

2 – BOOKING PROCESS <\/strong><\/p>\n

To book a trip, you must complete the online form on the website or send a request via email. A booking is considered confirmed only upon receipt of an email containing the trip details.<\/p>\n

3 – PARTICIPANT’S OBLIGATIONS <\/strong><\/p>\n

A 30% deposit is required at the time of booking, to be made at least 30 days prior to departure. The remaining 70% balance is due no later than 20 days before the experience begins. Accepted payment methods include credit card, PayPal, or bank transfer (Banca Generali IBAN: IT34O0307501603CC8001104081), NO AMERICAN EXPRESS. Before the experience begins, a security deposit of EUR 600.00 is required. This amount, corresponding to the deductible of the Kasko insurance policy, will be held on the participant’s credit card (not charged) and released at the end of the experience, provided that no damage has occurred. Participants must be in good health throughout the experience. Any change in health status must be promptly reported. The participant fully understands the risks involved in motorcycle riding and accepts full responsibility, thereby releasing the service provider from any liability. Wearing the provided protective gear and complying with traffic regulations is mandatory.<\/p>\n

4 – SERVICE PROVIDER’S OBLIGATIONS <\/strong><\/p>\n

The service provider is responsible for the proper execution of all services included in the contract and must provide assistance in the event of difficulties. Each motorcycle will be covered by adequate insurance.<\/p>\n

5 – RIGHT OF WITHDRAWAL<\/strong><\/p>\n

The participant may withdraw from the contract at any time: – Between 14 and 8 days prior to departure: 50% of the amount paid will be retained. – Within 7 days of departure: no refund will be granted. In case of extraordinary circumstances (e.g., severe weather, mechanical failure, illness of the guide), the service provider may cancel the experience. If possible, an alternative will be offered. If not accepted, the participant will be entitled to a full refund.<\/p>\n

6 – CONTRACT TRANSFER <\/strong><\/p>\n

The participant may transfer the contract to another eligible person by providing written notice at least 7 days in advance. Both the original participant and the transferee are jointly responsible for the outstanding balance and any administrative costs incurred. The provider will notify the transferor of the actual costs related to the transfer.<\/p>\n

7 – LOAN FOR USE <\/strong><\/p>\n

The motorcycle is provided on a free loan basis for the duration of the experience. Requirements: minimum age of 25, valid driver’s license suitable for riding motorcycles in Italy, and documented road experience. Non-EU citizens must have an international driver’s license. Driving under the influence of alcohol or drugs voids insurance coverage. The participant is responsible for any damage caused by negligence or misuse, and for any expenses resulting from police seizure due to such negligence.<\/p>\n

8 – PRIVACY AND DATA COLLECTION <\/strong><\/p>\n

Personal data is processed in accordance with Italian Legislative Decree No. 196\/2003. The Data Controller is Mr. Gianluca Passini. The provision of personal data is necessary for the performance of the contract. Data may be shared with third parties involved in delivering the service or fulfilling legal obligations. Any photos or materials voluntarily submitted by participants may be used for marketing purposes. All rights under Article 7 of Legislative Decree 196\/2003 may be exercised by contacting the Data Controller.<\/p>\n

9 – GOVERNING LAW AND JURISDICTION<\/strong><\/p>\n

This contract is governed by Italian law. Any dispute shall be submitted to the exclusive jurisdiction of the Court of Prato. 10 – COMMUNICATIONS All communications must be sent to: info@indianbiketherapy.it<\/a> or via certified email to indianbiketherapy@legalmail.it<\/a>.<\/p>\n
